My friends bike had a similar problem that we never really fixed just fitted a spare unit which looked identical which worked OK.

I think it was fallenmikethebike who suggested stretching the thin cylindrical spring that presses the ratchets together.
My thoughts are it can only be a lack of tension in this spring or wear in the shaft that the ratchet gears slide on that cause it to jam.
Don't know why your Kickstart is not springing back up. Check that the return spring is not broken and that it is tensioned correctly when you assemble it. The only other thing it could be is if the kickstart lever is catching on something.

Hope you find the cause and post up what it is. I know that it can be painful when you kickstart and it does not engage.

Like EE I have taken these apart and found no recognisable problem and ended up replacing with a working mechanism as refitting the original didn't work.

I am working my way through my collection of CRM bits at the moment to make room for other things and have a working setup if you are interested. Otherwise it goes on eBay sometime .........
